Points which Chorley overlooked

1) Lever Park is protected under the Liverpool Corporation Act 1902
2) The first paragraph of Chorley’s own policies” To promote the value of the Boroughs built Heritage and to maintain and enhance the quality of the Historic Environment”.
3) Section 5.26 refers to the protection of the Boroughs Historic villages and the Borough has,through its duty to conserve these Historic areas.There are nine designated areas of which Rivington is one.
4) section 5.41 refers to Lever Park and Rivington Gardens as being on the register of parks and gardens of special Historic interest and is registered with English Heritage,and they encourage those who have a role in its management and protection to treat it with special care.
5) section 5.42 requires them to consult the Garden History Society and English Heritage when considering proposals for developement.
6) section 5.43 states that these areas should be protected from insensitive developement,to safegaurd it for future generations.
7) HT13 states that developement will not be permitted if it would lead to the loss,or cause harm to,the Historic character or setting of any part of a park or garden of SPECIAL HISTORIC INTEREST.
Conclusion……Chorley Borough Council are guilty of ignoring their own policies which were edited in 2003,and also ignoring the 1902 Liverpool Corporation Act which is set in Law for the protection of Lever Park.
