I am aware of the deep concerns residents have about the Go Ape development at Rivington. It is worth pointing out that Planning and Planning procedure is the responsibilty of Chorley Borough Council.

 A member of my staff attended a meeting on Friday 17th October 08 between residents and the local planning authority, Chorley Borough Council.

Residents voiced their deep concerns and it was, in my opinion, clear that residents must continue with their complaints in line with procedure; this will allow residents to appeal to the Local Government Ombudsman.

However, after researching into the Liverpool Corporation Act 1902 I have put down three Parliamentary questions:

1.  Can the Minister confirm that the Go Ape planning application has breached the Liverpool Corporation Act 1902;
2. What are the constraints for felling trees in Lever Park at Rivington?;
3. What action can be taken if the Act has been broken?

I hope to have a reply to these questions by the end of next week.</description>

Ruth Kelly&#039;s office:
Ruth has liaised closely with Chorley MP Lindsay Hoyle on this matter as it his constituency that Lever Park resides in.   
Lindsay Hoyle has written to United Utilities and Chorley Borough Council to ascertain their respective positions on constituents objections to the development and he is yet to hear back from them.
He is also looking into a 1902 Act of Parliament to see whether this Act prevents commercial operation in the Park and whether planning permission could be halted on these grounds.
Ruth will continue to work closely with Lindsay Hoyle and I will update you as developments arise.

Lindsay Holye&#039;s office:
 I have been working with Friends of Lever Park in trying to establish how the plans would contravene the 1902 Act of Parliment and have also represented my constituent&#039;s views to Chorley Borough Council and United Utiltities. I believe your local MP is has also received a number of letters about the issue and so our offices have been keeping each other up to date. 
I have forwarded your email to a contact at your MP&#039;s office for their reference as I think it is important they are aware of the level of feeling against the proposals. 

Let us all hope that this results in success for the Friends of Lever Park and others who oppose the Go-Ape activity.</description>
